Transparency Law

Introduction

Through this document, the following companies comply with the provisions regarding TRANSPARENCY, as set out in the Canary Island Transparency Law 12/2014 and the State Law 19/2013. The Canary Island Law 12/2014, in article 3.1, letter b), includes private companies or entities that receive more than 60,000 euros annually in public aid as subjects within its scope; as does the basic state regulation (Law 19/2013), by establishing a set of reporting obligations more limited than those contemplated in the Canary Island regulation or other regional laws. The Canary Island Transparency Law indicates that “the commissioner is obliged to present an annual report to the Parliament of Canary Islands on the application and compliance with transparency obligations by the various public and private entities of the Autonomous Community, with the minimum content outlined in the law.” Article 64 states that private entities “must provide the commissioner or commissioner of Transparency and Public Information Access with the information they request and offer the necessary collaboration for the development of their functions. Specifically, they must maintain detailed, updated, and available information about the degree of application of the law in their respective fields of competence.”

It is an entity created by the Canary Islands Transparency Law and dedicated to promoting, analyzing, controlling, and protecting transparency and the right of access to public information within the Canary Islands. In exercising the functions attributed to it by Law 12/2014, of December 26, on transparency and access to public information, it must act with autonomy and full independence. The regulation of this body is set out in title IV of the aforementioned Law. The Transparency Commissioner is granted various powers, among which two main ones stand out: controlling compliance with the obligation to publish the information related in title II of the Law by the agencies and entities subject to it (known as “active publicity”); and resolving claims filed by citizens against the explicit or presumed acts resolving access requests to the information of the entities and agencies included within the scope of the Canary Islands Transparency Law.
